FOLLOW THE SOUL'S PATH
Generally, the dispute (the loss, the conflict, the death, the divorce, the violation, the crime, the tort, the bad act) is a doorway where we are offered a choice. Either we intend to follow our Soul's Path - or we get stuck in some circular pattern of distraction. If we are caught up in a distraction loop we keep doing the same things, suffering the same insults and having similar problems over and over and over again.
Distraction Loops
If we keep doing the same things, saying the same words and thinking the same thoughts, we're going to get the same results. For example, if I go out to dinner and want steak, I don't order lasagna. If we're caught in a distraction loop we're like a dog chasing his tail. We go around and around and around, and around, and we never get anywhere.
Soul Solution
If we move out of these distraction loops and get back on our Soul's path, ultimately, we reach freedom. We reach the solution to our problems once and for all. And, we don't have to continue to chase our tails, or stay stuck in unresolved conflict. Where cases come to an end and the underlying cause of the conflict has not been resolved, a similar problem will occur in the future.
Predator attorneys
There are attorneys who prey on clients who are stuck in their blame, frustration, selfishness and greed. If the client is resentful and seeks to impose guilt or shame on his opponent, many attorneys will take up the banner and fight intensely to perpetrate the greatest insult on the adversary. Preying on the fears and lower emotions of the client, further propagates the litigation mania that we see so much today.
Concluding Catherine's story
We thoroughly reviewed Catherine's motive for bringing a lawsuit against Ron to collect her money by going through the "Soul's Path" process (see diagram). Catherine lives very consciously and she is and was able to quickly correct some defective, off target thought process and to be honest with herself regarding her role in becoming a victim of fraud, again. Without blaming Ron or feeling guilty for setting herself up as a "victim", Catherine obtained a judgment against Ron. Ron has agreed to a payment plan, and she is prepared to collect the judgment if he defaults. Catherine said to me: "I feel so empowered, this will never happen to me again." I believe her.
MAKING A DIFFERENCE
Legal System
The technical term for the "soul's path" process that is outlined in this article "Loving Lawsuits", is MOTIVE-BASED DISPUTE RESOLUTION. This process could be used in all mediation, and pre-litigation negotiations. In my law practice, it has been effective in solving current problems and avoiding future similar altercations. To make the process more effective, both sides to an issue (plaintiff/defendant - petitioner/respondent) would be required to work through the process before litigation could be pursued. It would be effective to engage a team of professionals including a mediator, attorneys and counselors. Mediators, lawyers and counselors could be trained and certified in the application of the process. Ultimately, the cost of such a process would be substantially lower in terms of money, time, integrity and respect.
Personal
It is suggested that each litigant use the "loving lawsuits" process to:
1.Determine his/her genuine motive for becoming involved in the conflict and
2.Determine the correct choice to resolve the conflict. Then, the solution will be more easily reached.
Always be kind and loving to yourself. You are doing the best you can.
